These Terms of Service govern your use of the Leads By Data website, landing pages, and services. By submitting your information or engaging with Leads By Data in any way, you agree to these terms.
1. About the Service
Leads By Data provides done-for-you AI-powered lead generation and appointment booking systems for home renovation contractors. The service includes Meta advertising management, AI voice qualification calls, CRM setup, and related automation built on third-party platforms.
2. Eligibility
The Leads By Data service is intended for business owners operating legitimate home renovation businesses. By engaging with Leads By Data, you confirm that you are authorised to enter into a business agreement on behalf of your company.
3. Service Agreement
A formal service agreement will be provided to clients prior to commencement of any paid work. That agreement, once signed, governs the specific terms of delivery, pricing, and responsibilities for the engagement. These Terms of Service apply to general use of Leads By Data pages and enquiry forms.
4. AI Voice Calls and Contact Consent
By submitting your phone number through a Leads By Data form, you explicitly consent to being contacted by an automated AI voice agent and/or a human representative of Leads By Data. This contact may occur by phone, SMS, or email. You may withdraw consent at any time by contacting Leads By Data directly.
5. No Guarantee of Results
Leads By Data makes no guarantee of specific outcomes, including the number of leads generated, appointments booked, or revenue produced. Results depend on factors including market conditions, advertising budget, geographic area, and the quality of your business offering. Leads By Data will make every reasonable effort to deliver results but cannot be held liable for outcomes outside its control.
6. Payment Terms
Specific payment terms are outlined in the individual service agreement provided to each client. In general:
- A one-time setup fee is due prior to commencement of work
- Monthly management fees are billed in advance on a recurring basis
- Advertising spend is separate from Leads By Data fees and is paid directly to the relevant advertising platform
- There is no long-term contract — monthly management continues month to month until cancelled by either party
7. Cancellation
Either party may cancel the monthly management service with written notice. The setup fee is non-refundable once work has commenced. Any advertising budget already deployed to platforms at the time of cancellation is non-recoverable.
8. Intellectual Property
All systems, processes, templates, and methodologies developed by Leads By Data remain the intellectual property of Leads By Data. Clients retain ownership of their own business data, contacts, and creative assets provided to Leads By Data for the purpose of the engagement.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Leads By Data shall not be liable for any indirect, incidental, or consequential damages arising from use of the service or any outcomes connected to it. The total liability of Leads By Data shall not exceed the total fees paid by the client in the three months preceding any claim.
10. Third-Party Platforms
The Leads By Data service relies on third-party platforms including GoHighLevel, Synthflow, and Meta. Leads By Data is not responsible for outages, policy changes, or limitations imposed by these platforms that may affect service delivery.
11. Governing Law
These Terms of Service are governed by the laws of the Netherlands. Any disputes arising from these terms shall be subject to the jurisdiction of the competent courts of the Netherlands, unless otherwise agreed in a client-specific service agreement.
12. Changes to These Terms
Leads By Data may update these Terms of Service from time to time. Continued use of Leads By Data pages or services after changes are posted constitutes acceptance of the updated terms.
